Terms of Service

Welcome to Collably. These Terms of Service ("Terms") govern your access to and use of the Collably website, platform, and services available at www.collably.tz (together, the "Platform"). Collably is a non-governmental organization registered in the United Republic of Tanzania under the Non-Governmental Organizations Act, No. 24 of 2002, with its head office in Dodoma, Tanzania.

By creating an account, purchasing a membership, applying for a training, registering for an event, booking a service, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Who may use Collably

1.1. The Platform is intended for students, young people, and professionals in Tanzania and beyond who wish to learn, build, mentor, or partner with us.

1.2. If you are under the age of 18, you may only use the Platform with the knowledge and consent of a parent or guardian. There is no separate minimum age below which registration is not allowed.

1.3. Formal membership of the Organization (as defined in our Constitution) is open to individuals aged 18 and above. Platform accounts and participation in programs designed for secondary school students are governed by clause 1.2.

1.4. You agree to provide accurate, current, and complete information when creating an account and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2. Accounts

2.1. One person may hold only one account. Accounts are personal and may not be shared, sold, or transferred.

2.2. We may suspend or terminate accounts that violate these Terms, provide false information, or are used in ways that harm the Platform, its members, or the Organization's mission.

2.3. You may close your account at any time by contacting us at hello@collably.tz.

3. Membership

3.1. Collably offers a paid annual membership. Membership benefits may include discounted or free access to trainings, events, and services, priority access when capacity is limited, a verified digital membership ID, and a physical membership card on request.

3.2. Membership fees, benefits, and duration are as stated on the Platform at the time of purchase and may change for future membership periods. Changes will not reduce benefits already paid for during a current membership period.

3.3. Membership becomes active after your payment has been verified. Payment is made through the methods indicated on the Platform, and you may be required to submit proof of payment. We aim to verify payments within a reasonable time, typically within two business days.

3.4. Membership fees are non-refundable.

3.5. Membership is personal. Membership IDs and cards remain the property of Collably and must not be altered, lent, or used to misrepresent membership status.

4. Trainings, events, and services

4.1. Details of each training, event, or service, including price, member price, schedule, format, capacity, and any application requirements, are stated on the relevant Platform page.

4.2. Some trainings require a paid application. Submitting an application does not guarantee admission. Application fees are refundable if your application is not accepted, and non-refundable once you are accepted.

4.3. If we cancel a training, event, or paid service, you will be offered a transfer to a future equivalent or a refund of the amount paid for that item.

4.4. If you withdraw from a paid training or event at least 7 days before its start date, you will receive a full refund. Withdrawals after that point, and failing to attend, complete, or use a training, event, or service you paid for, are not refunded, except as required by applicable law or expressly stated on the relevant Platform page.

4.5. Schedules, instructors, and content may change where reasonably necessary. We will communicate significant changes to registered participants.

4.6. Completion of a training does not constitute an accredited academic qualification unless expressly stated.

5. Your conduct

You agree not to:

  • harass, abuse, discriminate against, or harm other members, instructors, mentors, partners, or staff;
  • submit false payment proofs, false identity information, or false application information;
  • use the Platform for unlawful purposes, or to promote schemes, scams, or ventures that are illegal in Tanzania;
  • copy, resell, or redistribute training materials, guides, or other Platform content without written permission;
  • attempt to gain unauthorized access to the Platform, other accounts, or our systems;
  • upload content that is unlawful, defamatory, obscene, or infringes another person's rights.

Violations may result in warning, suspension, removal from programs without refund, or termination of your account and membership, depending on severity. Conduct that appears criminal may be reported to authorities.

6. Your content

6.1. The Platform allows you to submit content such as profile information, Log Book entries, project descriptions, applications, and communications ("Your Content"). You retain ownership of Your Content.

6.2. You grant Collably a non-exclusive, royalty-free license to host, store, display, and process Your Content as needed to operate the Platform and provide services to you.

6.3. Ventures, projects, and works you build during your participation belong to you and your team, according to whatever arrangement you and your teammates agree between yourselves. Collably does not claim ownership of members' ventures or project work. We encourage teams to put their own agreements in writing early.

6.4. With your consent, we may feature your name, photo, project, or story in Collably's communications. You may withdraw consent for future use at any time by contacting us.

7. Collably's content

The Platform, including its design, text, guides, training materials, logos, and branding, is owned by or licensed to Collably and protected by applicable intellectual property laws. You may use it for your personal, non-commercial learning. You may not reproduce or distribute it commercially without our written permission.

8. Partners, instructors, and mentors

8.1. Experts may apply to join Collably as partners, instructors, mentors, or organizers. Applications are assessed at our discretion, and additional terms or agreements may apply to those roles.

8.2. Partners, instructors, and mentors act in a professional and personal capacity. While we take reasonable care in selecting them, advice and guidance they provide is their own and does not constitute professional advice from Collably (see clause 9).

9. No professional advice; no guaranteed outcomes

9.1. Content, trainings, mentorship, and services on the Platform are provided for educational and developmental purposes. They do not constitute legal, financial, investment, or other professional advice. For decisions with legal or financial consequences, consult a qualified professional.

9.2. Collably does not guarantee any particular outcome, including admission to institutions, loan approvals, employment, income, or the success of any venture. Building involves risk, and outcomes depend substantially on factors outside our control, including your own effort.

10. Third-party links and services

The Platform may reference or link to third-party websites, services, or institutions (for example HELSB, universities, or payment providers). We are not responsible for their content, policies, or actions.

11. Availability and changes to the Platform

We work to keep the Platform available and functional, but it is provided "as is" and "as available." We may modify, suspend, or discontinue features with reasonable notice where practicable. We are not liable for interruptions caused by maintenance, technical failure, or events beyond our reasonable control.

12. Limitation of liability

12.1. Nothing in these Terms excludes liability that cannot be excluded under the laws of Tanzania.

12.2. Subject to clause 12.1, Collably's total liability to you arising out of or in connection with the Platform or these Terms shall not exceed the total amount you paid to Collably in the twelve months preceding the event giving rise to the claim.

12.3. Subject to clause 12.1, Collably shall not be liable for indirect or consequential losses, loss of profit, loss of opportunity, or losses arising from ventures, projects, or decisions you undertake based on your participation.

13. Indemnity

You agree to indemnify Collably against claims, losses, and expenses arising from your breach of these Terms or your unlawful use of the Platform.

14. Termination

14.1. You may stop using the Platform and close your account at any time.

14.2. We may suspend or terminate your access as described in clauses 2.2 and 5. Where a serious breach leads to termination, fees already paid are not refunded except where the law requires otherwise.

14.3. Clauses which by their nature should survive termination (including 6, 7, 12, 13, and 16) survive.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows the current version. For material changes, we will give notice through the Platform or by email before the changes take effect. Continued use of the Platform after changes take effect constitutes acceptance.

16. Governing law and disputes

These Terms are governed by the laws of the United Republic of Tanzania. We encourage you to contact us first with any complaint so we can try to resolve it directly. Disputes that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Tanzania.
